Terms of Service Agreement for the Product and its Digital Content
By using this site, the User agrees with the following terms of service for Digital Content

1. Terms of Use

Thieme defines Product as the software, software features, interface and other elements that comprise this website. Thieme defines Digital Content as the information in any books, journals, and other material that can be viewed, downloaded, and for which a license may be granted for free or by required payment of a fee by a User for viewing and/or interacting with such information on an electronic device. Thieme defines a User as a person or entity which views, downloads, and/or interacts with such Digital Content, with or without paying a fee.

All Digital Content for license through this website is licensed by or to Thieme, and the User acknowledges and confirms that the material provided is protected by copyright and that the exclusive copyright in all forms remains with the copyright owners.

Thieme reserves the right to change the method of viewing, downloading, and purchasing a license to such Digital Content at any time without notice. After the specified fee is paid by the User of Digital Content, Thieme gives the User the non-exclusive right to view and download the applicable Digital Content for personal, non-commercial use. Thieme reserves the right to change without notice the number of devices on which Users may download, view, and/or interact with the Digital Content. The User is authorized to download select contents of this productfor classroom use only. In consenting to this Agreement, the User acknowledges that the copyright to the Digital Content, in both its original form and in forms as may be downloaded by the User and altered by the User, remain exclusively owned by Thieme and that to the extent that the User may create a derived work, the User transfers the exclusive copyright to Thieme. All copyright notices, other instructions or disclaimers of Thieme or the copyright holder in the online version of the publication, or all other similar screen texts must not be removed or altered in any way. No part of the Digital Content may be reproduced, posted, or distributed, whether for free or for a fee, to another party without prior written consent from Thieme or other copyright holders.

Your subscription to MedOne includes some content which is generally freely available through various sources (including open access material). Access to such content is not included in the subscription price and is included for the sake of user convenience.

Users or others may not attempt or assist others in accessing this website through hacking, password evading or meddling with security features in ways that could, but are not limited to, actions that interfere with the proper working of this website.

Violation of these security measures, including but not limited to impersonation of any other person or entity or attempt to access a Thieme User account that User is not the owner of, may result in civil or criminal liability.

2. User Submitted Content

Where the software features of the Product allow it, Thieme permits a User to submit or exhibit additional information, comments, and links to websites for viewing with the Digital Content. When a User submits his or her own content or content whose copyright is owned by others, the User agrees to obtain all necessary rights and licenses prior to the submission of such additional information.

If the User submits her or his own content, that User transfers to Thieme the nonexclusive, royalty- free right to reproduce, adapt, translate, or publish any such submitted User-submitted content worldwide without any compensation or permission from the submitting user. In addition, the User transfers to Thieme the right to view, delete and/or edit any User content submitted or exhibited without warning or liability to Thieme.

A User may not participate in any illegal, indecent or libelous conduct, and gives Thieme the right to monitor use of the Product and the Digital Content, and investigate any reports of perceived violations.

Notes taken on this Thieme MedOne platform when used under institutional IP-based access (i.e., not logged into your free personal account) can be viewed by all users at your institution who have access to MedOne. Inclusion of patient-specific information in notes entered on the MedOne platform is a violation of the MedOne terms of service.

3. Payment of Purchases

The User agrees, according to Thieme policy, to pay for a license for all Digital Content purchased on this website, including any late fees or taxes, on time and with valid account information. The User is responsible for keeping all account information accurate and current, and Thieme reserves the right to terminate a User account if account information is proven to be incomplete or false.

We may collect any or all of the information that Users give Thieme depending on the type of transaction the User enters into, including User name, physical address, IP address, telephone number, fax number and email address, together with data about the use of this website. Other information that may be needed from time to time to process a request may also be collected as indicated on this website.

Thieme reserves the right to change the prices of the Product at any time, without notice, and the access to the Product and Digital Content is non-returnable and all fees paid are non-refundable, subject to the proviso in paragraph 9.

4. Account Usage Information

To purchase a license to the Product and the Digital Content, a User must open a Thieme account and set up a username and password or employ a pre-existing account. User is responsible for any and all activity that occurs under her or his account, and is responsible for keeping the account information secure and confidential. Thieme will not be held liable for any losses sustained by someone else using a User account, but User may be held liable for such losses. Additionally, User may not use another User's Thieme account even with the stated consent of the account holder.

User is solely responsible for notifying Thieme when a breach of security has occurred. Thieme reserves the right to investigate cases of suspected unauthorized use or other contract violations and to take appropriate actions against, or prohibit the usage of this service by infringers. Thieme also reserves the right to make claims for compensation or damages if these terms of use are violated.

5. Privacy

User acknowledges and agrees that Internet transmissions are never completely restricted and secure, and User understands that any information User sends to this website (including encrypted information) may be intercepted by others.

Links to independent third-party websites are not under Thieme's control, and thus Thieme is not responsible or liable for any information provided or damage caused on external websites.

We do not disclose any personal information obtained about Users from this website to third parties. We may from time to time provide information of a general nature to third parties - for example, the number of individuals visiting our website or completing a registration form, but we will not use any information that could identify those individuals except as authorized or required by law.

Any changes to our Privacy Policy will be placed here and will supersede this version of our Privacy Policy. We will take reasonable steps to draw User attention to any changes in our Policy. However, to be on the safe side, we suggest that the User read this document each time User visits the website to ensure that it still meets with User approval.

6. Service Changes and Disclaimers

Thieme reserves the right to adapt, suspend, or discontinue any portion of this website hosting the Product and the Digital Content without notice or liability to Thieme. This includes interrupting the

operation of this website in order to perform maintenance or any changes to Product or Digital Content.

Thieme cannot ensure that any Digital Content that Users download from the site will be free of viruses, error, interruption, defect, delay in transmission, or any other detrimental features, and cannot ensure that any of the above problems will be corrected.

We make every effort to prepare all Digital Content accurately. It is, however, possible, especially in the HTML pages, that errors relating to conversion or appearance can occur. We also ask that Users be aware of the fact that some internet browsers do not always correctly display certain symbols (e.g. mathematical symbols, Greek letters, etc.).

7. DISCLAIMER OF WARRANTIES

THE PRODUCT AND ALL DIGITAL CONTENT, INCLUDING, WITHOUT LIMITATION, ALL SERVICES, FUNCTIONS AND MATERIALS, IS PROVIDED "AS IS," "WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING, WITHOUT LIMITATION, ANY WARRANTY FOR INFORMATION, DATA, DATA PROCESSING SERVICES, UPTIME OR UNINTERRUPTED ACCESS, ANY WARRANTIES CONCERNING THE AVAILABILITY, ACCURACY, USEFULNESS, OR CONTENT OF INFORMATION, AND ANY WARRANTIES OF TITLE, NON-INFRINGEMENT, MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, AND WE DISCLAIM ANY AND ALL SUCH WARRANTIES, EXPRESS AND IMPLIED. Medical knowledge is ever-changing. As new research and clinical experience broaden our knowledge,  

changes in treatment and drug therapy may be required. The authors and editors of the Digital Content herein have consulted sources believed to be reliable in their efforts to provide information that is complete and in accord with the standards accepted at the time of publication. However, in view of the possibility of human error by the authors and editors of the Digital Content, or changes in medical knowledge, none of the Protected Entities or any other party who has been involved in the preparation of this Digital Content, warrants that the information contained herein is in every respect accurate or complete, and they are not responsible for any errors or omissions or for the results obtained from use of such information. 8. Dispute Resolution

All matters and disputes regarding access or use of this website will be governed by United States laws.

9. Termination of Services

User agrees that Thieme may terminate, without prior notice, User access to this website or the Digital Content at its sole discretion. Fees will be refunded on a pro-rata basis, unless the User has failed to comply with any terms of service, in which case there will be no refund.
